These Terms of Service govern your access to and use of Book360AI, including our website, customer app, Aria AI receptionist, call handling, lead recovery, SMS and WhatsApp follow-up tools, ROI dashboard, and related services.
1. Acceptance of these Terms
By accessing or using Book360AI, you agree to these Terms. If you use Book360AI on behalf of a business or organization, you represent that you have authority to bind that business or organization to these Terms.
2. The service
Book360AI is an AI receptionist, lead capture, lead recovery, and customer communication platform. Our AI receptionist, Aria, can help answer calls, summarize conversations, capture leads, recommend follow-ups, and support customer communication workflows.
3. Accounts and security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate account and business information and to notify us promptly if you suspect unauthorized access.
4. Business configuration and customer communications
You are responsible for the business information, services, pricing, prompts, greetings, booking links, phone numbers, communication settings, and instructions you configure in Book360AI. You are also responsible for ensuring your use of calls, SMS, WhatsApp, and other communications complies with applicable laws, carrier rules, consent requirements, industry rules, and platform policies.
5. AI output may be imperfect
Book360AI uses AI systems that may generate incomplete, inaccurate, delayed, or unexpected responses, summaries, classifications, recommendations, or follow-up suggestions. You are responsible for reviewing critical information before relying on it. Book360AI should not be used as the sole source of truth for legal, medical, financial, safety, or other high-risk decisions.
6. No emergency use
Book360AI and Aria are not emergency services and must not be used for 911, emergency dispatch, urgent medical care, crisis response, or any situation where failure, delay, or inaccurate output could cause harm. If an emergency occurs, users and callers should contact local emergency services directly.
7. Third-party providers
Book360AI depends on third-party providers for parts of the service. These may include Google for authentication, Twilio and WhatsApp for messaging, Retell or similar providers for voice AI and call workflows, Cloudflare for hosting and infrastructure, Stripe for payments, and other service providers. Your use of Book360AI may also be subject to those providers' terms and policies. We are not responsible for outages, changes, or failures caused by third-party providers.
8. Subscriptions, payments, and cancellation
Paid plans, usage-based fees, setup fees, or add-ons may be billed through Stripe or another payment provider. By subscribing, you authorize us and our payment provider to charge the payment method on file for applicable fees and taxes. Unless otherwise stated, subscription fees are billed in advance and are non-refundable except where required by law or expressly agreed in writing.
You may cancel a subscription according to the cancellation process provided in the app or by contacting us. Cancellation may stop future billing but does not automatically refund past charges. Access to paid features may continue until the end of the current billing period unless otherwise stated.
9. Acceptable use
You agree not to use Book360AI to:
- Violate any law, regulation, platform rule, carrier rule, or third-party right.
- Send spam, deceptive messages, unlawful marketing, or communications without required consent.
- Collect or process sensitive information unlawfully or without authorization.
- Impersonate others, misrepresent your business, or deceive callers or recipients.
- Interfere with, reverse engineer, overload, disrupt, or abuse the service.
- Use the service for emergency response, harmful content, fraud, harassment, or illegal activity.
10. Customer data and privacy
Our handling of personal information is described in our Privacy Policy. You are responsible for providing any required notices to your customers and obtaining any required consents for call handling, recording, transcription, AI processing, SMS, WhatsApp, or other communications.
11. Intellectual property
Book360AI, Aria, our website, app, software, designs, branding, workflows, and related technology are owned by Book360AI or our licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the service for your business purposes during your active subscription or authorized access period.
12. Service changes and availability
We may modify, suspend, or discontinue features at any time. We aim to provide a reliable service, but we do not guarantee uninterrupted, error-free, or fully secure operation. Some features may be unavailable due to maintenance, third-party provider issues, internet failures, carrier restrictions, or force majeure events.
13. Termination
We may suspend or terminate access if you violate these Terms, create risk for Book360AI or others, fail to pay required fees, misuse communications, or use the service unlawfully. You may stop using the service at any time. Certain provisions, including payment obligations, disclaimers, limitations of liability, and dispute-related terms, survive termination.
14. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.
15. Limitation of liability
To the fullest extent permitted by law, Book360AI will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost business, or business interruption. To the fullest extent permitted by law, our total liability for all claims related to the service will not exceed the amount you paid to Book360AI for the service during the three months before the event giving rise to the claim.
16. Indemnification
You agree to defend, indemnify, and hold harmless Book360AI from claims, damages, liabilities, costs, and expenses arising from your use of the service, your business communications, your customer data, your violation of these Terms, or your violation of law or third-party rights.
17. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the effective date and may provide additional notice through the website, app, or email. Continued use of the service after changes become effective means you accept the updated Terms.
